Battle in Hawaii

Posted on: March 11, 2012

According to Courthouse News an interesting battle is shaping up in Hawaii.  Governor Neil Abercrombie is refusing to defend a state ban on gay marriage, making the state official who issues marriage licenses the person to defend the state in a lawsuit filed by Natasha Jackson and Janin Kleid.

“Under current law, a heterosexual couple can choose to enter into a marriage or a civil union. A same-sex couple, however, may only elect a civil union. My obligation as governor is to support equality under law. This is inequality, and I will not defend it,” Abercrombie said in a statement.

Meanwhile Health Department Director Fuddy will defend the ban, citing it as her official duty.

According to Courthouse News Attorney General Louie said that both Abercrombie and Fuddy will be “vigorously, and separately, represented” by separate teams of attorneys.
